Historical Significance for Roe V. Wade Case
Jan 22, 1973 was the date in which U.S.
Supreme Court after hearing many controversies which stated state and federal
legislation against abortion rights, trounced 'restricting abortion'. Before the
Roe case, abortion was considered illegal. However Roe V. Wade case's
significance uphold the creative decision in context with the fact that laws
'against abortion' not only violates 'privacy' according to the Fourteenth
Amendment of the Duo Process Clause, it also emerges women inequality in a
sense that it effects personal freedom to decide.
Randolph (2006) as a critique says "These
policy choices were dealt as if they were a part of constitutional law. The
vacuum left by Roe has never fulfilled. The court though has made an attempt to
fix the loopholes by filling in three words. These three words to patch up the situation
are: 'Duo' 'Process' and 'Liberty'". (Randolph, 2006) With an
endless debate, the Roe V. wade case is responsible for creating pro-Roe and anti-Roe.
It seems since 1973 Roe case is more critical than a simple decision which favors
and understands the consequences of the economic dilemmas of a middle class
family.
Whether one believes or not, my
personal opinion says that Roe case has affected two sectors, religious and
medical. The religious group serves as 'anti-Roe' by mentioning in proper
citations regarding Biblical passages. There would be no group happier than the
'Medical Association' of U.S.,
for being a 'pro-Roe'. I would not go into any depth of several reasons
associated with being a 'pro-Roe' of the Medical group as those who live in the
United States would simply understand the reason.
Roe's permissibility of abortions
until the visibility is, more than a debate that concerns human life
sustainability even in adverse circumstances. Therefore in this manner Roe
provides a woman complete freedom to 'cause and effect' situation. Mahowald
(1989) defends the Roe case and believes that Roe gives a flexibility to decide
till the third trimester. (Mahowald, 1989) In this manner I think that a woman
has enough time to decide whether she wants to keep her pregnancy or not.
